The Utah Procurement Code provides that a procurement may be made without competition when the University determines that there is only one source that can reasonably meet the University’s need for the required supply or service, as described in Utah Code Ann. § 63G-6a-802. Earliest Proposed Purchase Date:April 15, 2024 Buyer Name:Matt Cooney Sole Source Justification:Due to new HHS & OCR guidance around tracking technology for digital advertising and analytics for HIPAA covered entities, a technology privacy solution is needed for compliance that covers all third party vendors and online advertising. Some available solutions can solve for analytics, but they would require a full replacement of the current analytic solution, which would involve moving from Google Analytics, which is free, to a paid solution. It would also require IT resources and months of implementation. Other vendors can provide server-side tracking of events for advertising platforms; However, none of these solutions offer HIPAA-safe server-side integrations. The Freshpaint platform solves both the analytics and digital advertising compliance issues with one solution with minimal resources needed for implementation. Ongoing support would be limited as Freshpaint primarily serves healthcare clients and updates the software regularly based on new regulations.
