for Proposals\n\nThe State of New Hampshire, acting through the Department of Safety, Division of Fire\nStandards and Training and Emergency Medical Services (FSTEMS) is responsible for\ndevdoping and ddivering training to first responders throughout the state. RSA 21-P:12-g\nrequiresthatall fireservice personnd, fireservice dispatchers or emergency medical personnel\ncomplete amental healthtraining programfocused on post-traumstic stress whichis developed\nand delivered by FSTEMS. Additiondly, RSA 106-L:7-a require all law enforcement and\ndispatchers complete a mental health training program focused on post-traumstic stress which\nis devdloped and delivered by the Police Standards and Training Council (PSTC).\n\nPage 3 0f 27\nContractor Initials\n" "This RFP for ajoint project between FSTEMS and PSTC to devaop an online mental health\ntraining program to encompass the disciplines of fire, EMS, law enforcement, corrections,\nand dispatchers which meet the intent of RSA 12-P:12-g and RSA 106-L:7.\n\nIn this RFP, \u201cAgency\u201d means the NH Department of Safdty, Division of FSTEMS.\n\"V/\u2019endor\" means a person or entity who offers products or services for sale. \"Selected\nvendor\" means the qualified Bidder which has been identified by the Agency as having\nreceived the best score for its proposal according to the criteria setforth inthisRFP.\n\nD. Veendor Instructions\nI nterested vendors must read the entireRFP and submitthe required documents in themanner\n\nspecified in the RFP. Vendors are responsible for reviewing the most updated information\nrelated to this RFP before submitting proposals.\n\nSECTION 2- Requirements and Scope of Work\n\nThe Vendor shall serve as a subject matter expert in rdation to the devdopment of atraining\ncur culum that mests the requirements set forth in RSA 12-P:12-g and RSA 106-L:7. This\nindividual shall be available through the completion of the program. This contract is limited\nto atotal of 100 hours of services to aid inthe devdopment of the program.\n\ne Thevendor, shall belicensed Clinical Psychologists or licensed Clinical Mental\nHealth Professional who is culturally competent with mental healtin challenges\nthat first all first responders are faced with:\n\ne Attend curiculum planning, instructional design, and other\nprogram development sessions with FSTEMS and PSTC\n\n\u00ab Be avalable via phone email, or in-person for questions in\nregard to training requirements.\n\nThe vendor shall meet the following minimum experience requirements:\n\ne Clinical Psychologist or Clinical Mental Health Professional, licensed inthe State of\nNew Hampshire, and culturally competent with the mental health challenges of all\nfirst responder disciplines.\n\n\u00ab Have at lesst five (5) years previous professional experience working with first\nresponders.\n\nV\u2019endors\u2019 failure to meet these minimum prior experience requirements will cause their\nproposal to be considered non-responsi ve and their proposal will be rejected.\n\nPage 4 0f 27\nContractor Initials\n" "SECTION 3 -- Contract Terms and C onditions\n\nA. Non-Exclusive C ontract\n\nAny resulting Contract fromthis RFP will be a non-exclusive contract. The Agency reserves\nthe right, at its discretion, to retain other contractors to provide any of the services or\ndeliverables identified inthisRFP or make an award by item, partor portion of an item, group\nof iterrs, ortotal Proposal.\n\nB. Award\n\nIf the Agency decides to award a contract as a result of this RFP process, any award is\ncontingent upon approval of the contract by the Governor and Executive Council of the State\nof New Hampshire and upon continued appropriation of funding for the contract.\n\nC. Standard Contract Terms\n\nThe Agency will requirethe sdlected vendor to execute a contract using the Standard Terms\nand Conditions of the State of New Hampshire (FormP-37) which is attached as Appendix\nA. In no event is a vendor to submit its own standard contract terms and conditions as a\nreplacement for the State\u2019 s terms in response to this solicitation.\n\nThetems of this RFP and the sdeected vendor\u2019s Proposal will be used to formtheterms of\nany resulting contract. The resulting contract may incorporate some or all of the sdected\nvendor\u2019s Proposal. References in the P-37 to Exhibits A, B and C are references to the\nrequired structure of any resulting contract (Exhibit A - Specidl Provisions/Amendments to\nthe P-37, Exhibit B - Scope of Services, and Exhibit C - Payment Terms) and are not\nreferences to sections of thisRFP.\n\nTo the &xtent that a vendor believes that exceptions to the contract terms in Appendix A\nwill be necessary for the vendor to enter into the contract, the vendor must note those issues\nduring the endor Inquiry Period, as further described Section 4B.\n\nSECTION 4 -Request for Proposal Process\n\nA. Agency Point of C ontact/Restriction of Contact with Agency E mployees\n\nThe sole point of contact for this RFP, from the RFP issue date until the approval of the\nresulting contract by the Governor and Executive Council is:\n\nHeather Clough Hesther.C.Clough@dos.nh.gov\n\nFrom the date of rdlesse of this RFP until an award is made and announced regarding the\n\nselection of a vendor, all communication with personnd employed by or under contract with\n\nthe Agency regarding this RFP is prohibited unless first approved by the RFP Sole Point of\n\nContact. Agency employees have been directed not to hold conferences and/or discussions\n\nconcening this RFP with any potential contractor during the sdection process, unless\nPage 5 0f 27\n\nContractor Initials\n" "otherwise authorized by the RFP Sole Point of Contact. Vendors may be disqualified for\nviolating this restriction on communications.\n\nB. Vendor Inquiries\n\nAll inquiries conceming this RFP, including but not limited to, requests for clarifications,\nquestions, any changes to theRFP, and any exceptions to the contract terms in Appendix A,\nincluding the Form P-37, shall be submitted via email to the Agency Point of Contact\nspecified above Inquiries must be received by the end of vendor inquiry period (see\nScheduleof Events herein).\n\nThe vendor must identify the RFP name and the number and include the vendor\u2019s\nname, tdlephone number, and e-mail address.\n\nTheAgency will issue responses to properly submitted inquiries on or beforethe date specified\nin the Schedule of Events; however, this date is subject to change at the Agency\u2019s discretion.\nThe Agency may consolidate and/or paraphrase questions for sufficiency and darity. The\nAgency may, at its discretiion, amend this RFP on its own initidive or in response to issues\nraised by inquiries, as it deems appropriate. In response to requested exceptions to P37, the\nAgency will review requested exceptions and accept, rgect, or notethatitisopento negotiation\nof the proposed exception at its sole discretion. Questions about or requested exceptions to the\nRFP, Form P-37 and/or any rdevant attachments not raised during the inquiry period are\nwaived. Ordl st\u00e4terments, representations, clarifications, or modifications conceming theRFP\nshall not be binding upon the Agency. Official responses by the Agency will bemade only in\nwriting by the process described above. Vendors shall be responsible for reviewing the most\nupdated information related to this RFP before submitting a proposal.\n\nC. Vendor Conference (if applicable)\nFSTEMS does not plan on holding a vendor conference, however, should circumstances\n\ndictate that a conference becomes necessary, attendance by all V endors will be mandatory,\nwith directions issued to each V endor at thattime.\n\nSECTION 5- RFP Terms and Conditions\n\nA. Debarment\n\nV\u2019endors who are indigible to bid on proposals, bids or quotes issued by the Department of\nAdministrative Services, Division of Procurement and Support Services pursuant to the\nprovisions of RSA 21-1:11-c shall not be considered digiblefor an award under this RFP.\n\nB. Proposal Preparation C ost\n\nBy submitting a proposal, a vendor agrees that in no event shall the Agency be either\nresponsible for or held liable for any costs incurred by a vendor in the preparation of or in\n\nPage 6 0f 27\nContractor Initials\n" "connection with the Propos\u00e4,, or for work performed prior to the Effective Date of aresulting\nContract.\n\nC. Validity of Proposal\n\nProposals must be valid for one hundred and eighty (180) days following the deadline for\nsubmission of Proposals in Schedule of Events, or until the Effective Date of any resulting\nContract, whichever is later.\n\nD. RFP Addendum\n\nThe Agency reserves the right to amend this RFP at its discretiion, prior to the Proposal\nsubmission deadline. In the event of an addendum to this RFP, the Agency, at its sole\ndiscretion, may extend the Proposal submission deadline, as it deems appropriate.\n\nE. Non-C ollusion\n\nThe vendor\u2019s signature on a Proposal submitted in response to this RFP guarantees that the\nprices, terms and conditions, and work quoted have been established without collusion with\nother Vendors and without effort to preclude the Agency from obtaining the best possible\ncompetitive Proposal.\n\nF. Property of the Agency\n\nAll material recaved in responseto this RFP shall become the property of the Agency and\nwill not be retumed to the vendor. Upon contract award, the Agency reserves the right to\nuse any information presented in any Proposal.\n\nG. Proposal C onfidentiality\n\nUnless necessary for the approval of a contract, the substance of a proposal must\nremain confidential until the effective date of any contract resulting fromthisRFP. A\nvendor\u2019s disclosure or distribution of Proposals other than to the Agency may be\ngrounds for disqualification.\n\nH. Public Disclosure\n\nThe information submitted in response to this RFP (including all materials submitted in\nconnection with it, such as attachments, e&xhibits, addenda, and presentations), any resulting\ncontract, and information provided during the contractual rdationship may be subject to\npublic disclosure under Right-to-Know law, including RSA 91-A. In addition, in accordance\nwith RSA 9-F:1, any contract entered into as aresult of this RFP will be made accessible to\nthe public online via the website Transparent NH (http://www.nh.gov/transparentnh/).\n\nConfidential, commercial, or financial information may be &xerrpt from public disclosure\nunder RSA 91-A:5, IV.
