Notice of Intent to Procure Satellite Data Transmission Services on a Sole Source Basis

This is a Special Notice of intent to procure satellite transmission of electronic logbook data for for the Department of Commerce (DOC), National Oceanic & Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Pacific Islands Fisheries Science Center (PIFSC) on a sole source basis from the Woodshole Group (formerly CLS America, Inc.). The Government intends to acquire services using FAR Part 12, Acquisition of Commercial Items in conjunction with FAR Part 13, Simplified Acquisition Procedures. Participants in the Hawaii and American Samoa-based longline were previously outfitted with VMS units manufactured by CLS America. The units were purchased by the NOAA Office of Law Enforcement (OLE) in order to obtain geographic location information for the vessels. The CLS Thorium VMS units are Iridium-based and include proprietary hardware which makes it impossible for other vendors to provide satellite services using these units. This electronic hardware is loaded

with electronic reporting software, which will be used for daily electronic reporting within the fleet. In order to support daily reporting, the electronic logbook software is required to submit data through a satellite transmission to PIFSC. Customized software has been developed for PIFSC by CLS America which enables the transmission daily longline catch and effort data.The Government intends to negotiate a firm-fixed-price purchase order with an approximate period of performance of approximately October 1, 2018 - September 30, 2019. The NAICS code for this procurement is 518210 with a corresponding size standard of $32.5. This Special Notice is not a request for competitive proposals and no solicitation package is available; however, other potential sources with the expertise and required capabilities may submit such data which demonstrates the requirements stated above. Submissions are due no later than August 31, 2018 at 2:00 p.m. HST. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. It is the Government's belief that only the Woodshole Group can provide the requirements as stated above.This procurement also requires contractors to complete the electronic representations and certifications at the SAM website. All vendors doing business with the Government are required to be registered with the System for Award Management (SAM). No award can be made unless the vendor is registered in SAM.
