SSW is representing the Customer(s) as its Bid Administrator, and any rights or obligations of SSW enumerated herein will be exercised on the Customer(s)’s and the Additional Purchaser’s behalf and in their best interests. The

qualified Proponents that are identified pursuant to the evaluation process ARTICLE 8- EVALUATION PROCESS (“Qualified Proponents”) may be asked on an “as, if and when requested basis” to participate in a Stage 2 Requests for Proposals (“RFP”) or Requests for Quotes (“RFQ”) for procurement of Deliverables by Additional Purchasers. SSW reserves the right to: (i) select any number of Qualified Proponents to be added to the Pre-qualified List; (ii) not select any Qualified Proponents from the pre-qualified list; (iii) undertake a separate procurement process for the purchase of Deliverables; or (iv) carry out such other actions as are specifically identified in this RFSQ. The objectives of this RFSQ are to: • Address an immediate need by the Customer(s) to purchase the Deliverables; • Establish an independent pre-qualified list for the benefit of Additional Purchasers; • There will be a Stage 1 evaluation where SSW aims to get price proposals for pre- qualification. Any proponent that will not be included in the pre-qualified list will not be evaluated for Stage 2. • There will be a Stage 2 evaluation for THP and Halton. Only the pre-qualified vendors from Stage 1 will be evaluated in Stage 2.
