California Public Utilities Code Section 99246 requires that transportation planning agencies, such as MTC, designate independent entities to conduct performance audits of their activities and of the activities of each transit operator to whom they allocate funds under Article 4 of the Transportation Development Act (TDA). The purpose of the audits is to systematically evaluate the efficiency, effectiveness, and

economy of the operation of the entity being audited. These audits are required triennially, are to be submitted to the State of California, and are to be made available for public inspection. MTC and the transit operators are required to be audited triennially. MTC splits the operators into three groups with one group audited in a three-year “round.” Audits that would have been conducted in 2022 will be performed in addition to the normally scheduled operators during the first round. The Consultant may also be asked to provide assistance with Regional Measure 2 (RM2) and/or Regional Measure 3 (RM3) Operating Programs performance and monitoring. RM2 and RM3 statutes require operators to report performance to MTC for adopted performance measures.
