Contract 75ACF122C00016 (00016) was awarded to Family Endeavors, Inc. to provide an influx care facility (ICF) and related services necessary for the operation of a temporary U.S. Department of Health and Human Services (HHS), Office of Refugee Resettlement (ORR), ICF for the care of unaccompanied children (UC) at the Family Endeavors site in Pecos, TX. Contract 00016 was awarded on May 16, 2022, under the authority of FAR 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements,” 41 U.S.C. 3304(a)(1). The contract was awarded as firm-fixed-price (FFP), with a total period of performance from May 16, 2022 to May 15, 2023, with the option to extend services for up to six months (through November 2023). The Pecos, Texas ICF has a bed capacity of up to 3,000 beds for UC.The following was identified as the period of performance for Contract 00016 at the time of award:Base Period: 5/16/2022 to 08/15/2022Option Period 1: 08/16/2022 to
11/15/2022Option Period 2: 11/16/2022 to 02/15/2023Option Period 3: 02/16/2023 to 05/15/2023FAR 52.217-8: Option to extend services for up to six monthsUnder the Homeland Security Act of 2002 and the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (TVPRA), ORR is responsible for accepting referrals and providing care for and custody of UC in federal custody by reason of their immigration status. The TVPRA, at 8 U.S.C. § 1232(b)(3), requires, absent exceptional circumstances, any federal agency that has an UC in its custody to transfer custody of such child to HHS/ORR within 72 hours of determining that such child is an UC. Typically, ORR receives referrals of children from the U.S. Department of Homeland Security (DHS). Beginning in March 2021, the number of DHS referrals far exceeded the number of available beds for UC, which resulted in the need for Emergency Intake Sites (EIS). By June 2022, all but two sites were closed. The two sites that remain open, the Pecos, Texas site and the Fort Bliss, Texas site, reached standard of care levels to be reclassified as ICFs in 2022. Currently, these two ICFs are the only ICF locations with available bed capacity for placement of UC. Until additional bed space becomes available through the use of competitive contracts, grants, and other sources, continued access to bed capacity at the Pecos ICF is necessary for ORR to comply with its statutory responsibilities to accept referrals and provide care for and custody of UC in federal custody by reason of their immigration status. The purpose of this justification and approval (J&A) is to:A. Make the Pecos ICF J&A publicly available, as required by FAR 6.305(a).B. Provide the total estimated value of Contract 00016. C. Add two (2), three-month option periods to Contract 00016. The additional option periods are as follows:Option Period 4: 05/16/2023 to 08/15/2023Option Period 5: 08/16/2023 to 11/15/2023
