If any provision of this RFSQ conflicts with the UCA or UAC, the UCA or UAC will take precedence. Purpose of this Solicitation The State of Utah, Division of Purchasing has issued this RFSQ to obtain statements of qualifications from companies interested in conducting a waste characterization study. (This study will provide the Division with vital information to understand current waste streams throughout the state and assist with policy and planning for future sustainable material management practices in Utah) with the intent to award a contract under Utah Procurement Code 63G-6a-1501 for the Purchase of Professional Service Providers and Consultants. It is anticipated that this RFSQ/SOIQ will result in a single contract award to the responsive and responsible who is the most qualified. Evaluations will be conducted according to the State of Utah Procurement Code 63G-6a-1503.5 and awarded according to 63G-6a- 1505: 63G-6a-1503.5 Evaluation of statements of qualifications. consultant to provide this service. (1) An evaluation committee appointed under Section 63G-6a-1503 shall evaluate and score each responsive statement of qualifications that has not been eliminated from consideration under this chapter, using the criteria described in the request for statement of qualifications. (2) Criteria not described in the request for statement of qualifications may not be used to evaluate a statement of qualifications. (3) An evaluation committee may enter into discussions or conduct interviews with, or attend presentations by, the design professionals whose statements of qualifications are under consideration. (4) An evaluation committee shall rank the top three highest scoring design professionals, in order of their scores, for the purpose of entering into fee negotiations as provided in (5) If fewer than three responsible design professionals submit statements of qualifications that are determined to be responsive, the procurement official shall issue a written determination explaining why it is in the best interest of the procurement unit to continue the fee negotiation and the contracting process with less than three design professionals. (6) (a) The deliberations of an evaluation committee may be held in private. (b) If the evaluation committee is a public body, as defined in Section 52-4-103, the evaluation committee shall comply with Section 52-4-205 in closing a meeting for its deliberations. 63G-6a-1505. Determination of compensation for design professional services. (1) The procurement officer shall award a contract to the qualified design professional whose statement of qualifications was awarded the highest score under Subsection 63G-6a-1503(4) by the evaluation committee, at compensation that the procurement officer determines, in writing, to be fair and reasonable to the procurement unit. (2) In making the determination described in Subsection (1), the procurement officer shall take into account: (a) the estimated value, scope, and professional nature of the services; and (b) the complexity of the project or services. (3) If the procurement officer is unable to agree to a satisfactory contract with the highest scoring design professional, at a price the procurement officer determines to be fair and reasonable to the procurement unit, the procurement officer shall: (a) formally terminate discussions with that design professional; and (b) undertake discussions with the second highest scoring, qualified design professional. (4) If the procurement officer is unable to agree to a satisfactory contract with the second highest scoring design professional, at a price Description the procurement officer determines to be fair and reasonable to the procurement unit, the procurement officer shall:(a) formally terminate discussions with that design professional; and (b) undertake discussions with the third highest scoring, qualified design professional. Contract Time Frame: Up to 3 years or end of the project, whichever comes first. Background The State of Utah Division of Waste Management and Radiation Control is seeking to conduct a waste characterization study. This study will provide the Division with vital information to understand current waste streams throughout the state and assist with policy and planning for future sustainable material management practices in Utah, including underserved areas of the state. Study activities will consist of observations at solid waste facilities, performing a survey of individuals and or companies determined by the Division and contractor, along with conducting research to support the study. The results of the study should reflect an improved awareness of any materials being disposed of, reused, or recycled in the state, as well as identifying the reduction, reuse, or recycling methods currently underutilized by market regions throughout the state. Data will provide a better understanding of the perceived and actual social and economic support for recycling. The information gathered through these efforts must be sufficient to inform updates to the Utah Solid Waste Management Plan, apprise policymakers about the current status of recycling in the state, and identify opportunities for improvement. Progress reports will be given to the Division bi- weekly throughout the study. The survey portion of the study is expected to be complete by September 23, 2024, and the waste characterization study and draft final report delivered to the Division by January 30, 2025, with a final report delivered by March 31, 2025. Issuing Procurement Unit, Conducting Procurement Unit, and Solicitation Number The State of Utah Division of Purchasing is the issuing procurement unit and the State of Utah Division of Waste Management and Radiation Control is the conducting procurement unit for this RFSQ (referred to as “the State”). The reference number for this RFSQ is Solicitation #JH24-48. This solicitation number must be referred to on all bids, correspondence, and documentation submitted to the State relating to this RFSQ. Additional Information: Legislative Appropriation Additional funding may be added to the awarded contract(s) if additional funding is provided to the procurement unit for the purpose identified in the scope of work by the legislature. Evaluation of Statements of Qualifications Each Statement of Qualifications received shall be evaluated for responsiveness in as outlined in the Utah Procurement Code. Pursuant to Administrative Rule R33-15-303, the Conducting Procurement Unit will evaluate the qualifications of all submitted responses and will select the vendor who is most qualified for direct negotiations. Any exceptions to the content of this RFSQ, including the prerequisites, must be protested in writing to the Division of Purchasing prior to the closing date. To be responsive and responsible Vendors must review and respond to the following sections of this RFSQ: Prerequisites, Buyer Attachments, and Questions. • The Prerequisites Section contains the objective criteria that will be used to evaluate the statement of qualifications, including the mandatory minimum requirements and general requirements that Vendors must certify that they have read, understand, and agree in order to submit a response. • The Buyer Attachments Section contains the required State of Utah Terms and Conditions of the RFSQ, which are non- negotiable, the General Provisions which apply to this RFSQ, and any additional required forms. • The Questions Section contains the questions that Vendors are required to answer in order to submit their Statement of Qualifications. Vendors must review each section carefully.
