The Naval Air Systems Command (NAVAIR) intends to issue a sole source Cost Plus Fixed Fee Order under Basic Ordering Agreement (BOA) N00019-19-G-0001 to L3 Technologies, Inc. Communications Systems-West (L3), Salt Lake City, UT, for the resolution of obsolete AN/ARQ-59 and AN/ARQ-4 Common Data Link (CDL) components, resolution of program trouble reports (PTRs) in the AN/ARQ-59, and to reduce the number of hardware and software versions of the AN/ARQ-59 to three specific variants in support of Domestic and Foreign Military Sales (FMS). The projected period of performance is twenty-four (24) months.This action is being awarded on a sole source basis to L3 under authority permitting other than full and open competition, Title 10, U.S.C. 3204(a)(1), as implemented by FAR 6.302-1 “Only One Responsible Source and No Other type of Supplies or Services Will Satisfy Agency Requirements.” L3 exclusively designed and developed the H-60 AN/ARQ-59 Common Data Link System and the Shipboard AN/SRQ-4
under a competitively-awarded effort. The current action is a follow-on to that work, and L3 is the only source with the requisite knowledge and skilled personnel, software, and technical data necessary to provide the required supplies and services.Note: This notice of intent is not a request for competitive proposals. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under authority of FAR 6.302. The Government does not intend to fund the development or qualification of other sources for fulfilling this requirement, as the development and testing of AN/SRQ-4 and AN/ARQ-59 Common Data Link systems require a substantial initial investment or an extended period of preparation for qualification. However, the Government will consider all proposals received within thirty days after the publication of this synopsis. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
