The City of Santa Clara (herein after, “City”) is soliciting bids from qualified Contractors to provide all necessary supervision, labor, and services plus all tools, equipment, materials and supplies required to provide on-call on-site repair and maintenance services to restore, correct, recondition: battery charger(s), inverter(s) and uninterruptible power supply (UPS) for the City's Silicon Valley Power (SVP) facilities. ESTIMATED QUANTITIES: The quantities specified herein are the City's best estimate of the quantities and services that will be purchased; however, they are not guaranteed. Any variations from these estimated quantities shall not entitle the bidder to an adjustment in unit pricing or rates. GENERAL INSTRUCTIONS:1) See Attachment A - Scope of Services. 2) Please refer to the RFB Instructions and General Provisions document and any other attached documents for details. 3) Submit all response documents online through PeriscopeS2G, including electronic attachments if
applicable, and/or through the “Vendor Notes for Offer” function. The City will not accept hardcopy response documents. 4) Final award shall be contingent upon selected firm (Contractor) accepting the City’s Sample Exemplar Agreement Terms and Conditions. REQUIREMENTS:1) Please refer to the RFB Instructions and General Provisions document and any other attached documents for details. BID SUBMISSION:All Bid responses must be submitted online through PeriscopeS2G, including electronic attachments if applicable, and/or through the “Vendor Notes for Offer" function. All line items must be priced or clearly show “No Charge” or “included” not left blank or zero. SALES TAX: Do not include sales tax in your bid. City will work with selected supplier to establish the applicable tax for contract award. FREIGHT/SHIPPING: Freight and/or shipping charges shall be at no cost to the City “FOB Destination prepaid" unless specified by Buyer as separate line item on bid. In the event of special or expedited orders where incremental transportation or shipping fees are incurred by Bidder, those incremental freight charges shall be added as a separate line item to the invoice submitted. BASIS OF AWARD : Price-Determinative. The award for this requirement will be based on lowest responsive and responsible total base bid that meets all specifications. POST AWARD SUBMITTAL REQUIREMENTS: The successful contractor will be required to provide the following requirements and must be provided within five calendar days of notification of award or as stated otherwise: 1) Certificate of Insurance 2) A valid City of Santa Clara Business Tax Certificate PRICING: Pricing shall be fixed for the first two (2) years of the Agreement. **In order to comply with the Governor's Executive Order, the following information is provided which will be included in City bids and agreements until such time that the EO is rescinded. On March 4, 2022, Governor Gavin Newsom issued Executive Order N-6-22 (EO) regarding sanctions in response to Russian aggression in Ukraine. The EO is located at https://www.gov.ca.gov/wpcontent/ uploads/2022/03/3.4.22-Russia-Ukraine-Executive-Order.pdf. The EO directs the City of Santa Clara to take certain immediate steps, including notifying all contractors and grantees of their obligations to comply with existing economic sanctions imposed by the U.S. government in response to Russia's actions in Ukraine, as well as any sanctions imposed under state law. This correspondence serves as a notice under the EO that as a contractor or grantee, compliance with the economic sanctions imposed in response to Russia’s actions in Ukraine is required, including with respect to, but not limited to, the federal executive orders identified in the EO and the sanctions identified on the U.S. Department of the Treasury website ( https://home.treasury.gov/policy-issues/financial-sanctions/sanctionsprograms-and-country-information/ukraine-russia-related-sanctions). Failure to comply may result in the termination of contracts or grants, as applicable.
